Who's the bad person; Molester or Molestee?

According to laws of most of the 50 states, the 'bad' person would be the one who actually touches the person who does not want to be touched. If the person wearing the revealing clothing actually shows off something they should not, then it can be public indecency and they to could be a 'bad' person in the eyes of the law.
